This User Agreement (“Agreement”) governs your use of the GX Slingshots website, products and services (collectively, “Services”). By using the Services, you agree to be bound by this Agreement, as it may be amended from time to time. If you do not agree to these terms, do not use the Services.

1. Use of Services. The Services are for your personal, non-commercial use. You may not use the Services for any illegal purpose or in any way that infringes on the rights of others.
   
   
2. Ownership of Content. All content available through the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of GX Slingshots or its content suppliers and is protected by South African and international copyright and trademark laws. The compilation of all content available through the Services is the exclusive property of GX Slingshots and is protected by South African and international copyright laws.
   
   
3. User Contributions. The Services may permit users to submit, upload, publish or otherwise make available content, including but not limited to text, photographs, videos, and reviews (“User Contributions”). You retain all rights in, and are solely responsible for, the User Contributions you make.
   
   
4. User Conduct. You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
   
   
5. Intellectual Property Infringement Claims. If you believe that any material available through the Services infringes upon any copyright you own or control, you may send a written notification of such infringement to GX Slingshots’s designated copyright agent.
   
   
6. Disclaimer of Warranties. THE SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. GX SLINGSHOTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
   
   
7. Limitation of Liability. GX SLINGSHOTS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF YOUR USE OF THE SERVICES.
   
   
8. Indemnification. You agree to indemnify, defend, and hold harmless GX Slingshots, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, agents, licensors, suppliers, successors, assigns, content providers, and other representatives from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Services using your account.
   
   
9. Termination. GX Slingshots may terminate this Agreement, or any part thereof, or your use of the Services, at any time, with or without notice to you.
   
   
10. Governing Law. This Agreement will be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to its conflicts of law provisions.

Purchasing Online

I, the purchaser of GX Slingshots products, understand and agree to the following terms and conditions:

1. Order Confirmation: Upon placing an order with GX Slingshots, I understand that my order will be confirmed by the company.
   
   
2. Product Availability: GX Slingshots reserves the right to limit the quantity of products available for sale, and may, at its discretion, discontinue any product at any time.
   
   
3. Product Description: GX Slingshots strives to provide accurate descriptions and images of its products, however, the company does not guarantee that the descriptions, images or other content available on its website are error-free, complete, reliable, current, or free of viruses.
   
   
4. Product Pricing: GX Slingshots reserves the right to change its product prices at any time without notice. The price of a product will be the price in effect at the time the order is placed and will be set out in the confirmation email.
   
   
5. Payment Terms: Payment for all products must be made in full before shipment. GX Slingshots accepts payment via EFT and Direct Deposits. All payment will require a POP and Reference to order. 
   
   
6. Delivery: GX Slingshots will deliver the purchased products to the address specified by the purchaser. Delivery times may vary depending on the location and availability of the products.
   
   
7. Returns and Refunds: If for any reason the purchaser is not satisfied with a purchase, the company will accept the return of the product in its original condition and packaging, within 14 days of delivery for a full refund or exchange.
   
   
8. Warranty: GX Slingshots warrants that its products will be free from defects in materials and workmanship for a period of 30 days from the date of delivery.
   
   
9. Limitation of Liability: GX Slingshots will not be liable for any indirect, incidental, special or consequential damages arising out of the use of its products.
   
   
10. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
    
    

By purchasing a product from GX Slingshots, I agree to be bound by the terms and conditions set forth in this user agreement.
